Terms of service

These Terms of Service govern your purchase and use of website design, development, hosting, maintenance, and support services provided by Inkstand. By purchasing a plan or approving a written proposal, you agree to these terms and any project-specific scope we provide in writing.

1. The managed website plan

The standard Inkstand plan costs $149 USD per month with no setup fee. It is billed in advance on a month-to-month basis and continues until canceled. The standard plan includes one bespoke website, managed hosting, SSL, routine maintenance, one standard domain or connection of a domain you own, and one consolidated standard content-update request per monthly billing period.

During the first 30 days after the initial preview, we include reasonable launch refinements. New pages, structural redesigns, e-commerce, custom software, complex integrations, and unusually large update requests are outside the standard plan and require a separate written quote.

2. Project timing and approvals

Most standard sites can launch within 3 days after we receive all required content, access, and approvals. Timing is an estimate, not a guarantee, and may change based on scope, third-party services, or delayed client feedback. You are responsible for reviewing previews and confirming that business details are accurate before launch.

3. Your content and responsibilities

You must provide accurate business information and only supply text, photography, trademarks, and other materials that you own or have the right to use. You remain responsible for your business claims, licenses, regulatory obligations, accessibility obligations specific to your industry, and the legality of the products or services you offer.

4. Payments

Monthly charges are processed through Stripe. Your card statement will show INKSTAND. You authorize recurring charges until cancellation. If a payment fails, we may retry the charge and suspend hosting or support after reasonable notice until the account is current. You are responsible for applicable taxes unless the law requires us to collect them.

5. Cancellation and refunds

You may cancel at any time by emailing hello@inkstand.nyc before your next renewal. Cancellation stops future billing and takes effect at the end of the current paid period. Fees already paid are generally non-refundable once the applicable service period or substantive design work has begun, except where required by law. 6. Ownership and handoff

You retain ownership of content and trademarks you provide. Inkstand retains ownership of its pre-existing tools, reusable systems, processes, and template methods. While your account is current, we grant you the right to use the completed site for your business.

After cancellation and payment of any outstanding balance, we will make a reasonable effort to transfer a client-owned or plan-included standard domain and provide a static export of the completed site. Third-party subscriptions, licensed assets, dynamic services, and proprietary tooling may not be transferable. Registrar transfer rules can delay a domain handoff.

7. Third-party services

Sites may connect to third-party services such as booking, ordering, analytics, maps, social media, payment, and email providers. Their terms, availability, privacy practices, and fees are outside our control. We are not responsible for outages or changes caused by those providers.

8. Warranty and liability

We provide services with reasonable professional care, but do not guarantee uninterrupted operation, specific search rankings, traffic, revenue, or business results. To the fullest extent permitted by law, Inkstand’s total liability arising from the service will not exceed the amount you paid Inkstand during the three months before the event giving rise to the claim. We are not liable for indirect, special, incidental, or consequential damages.

9. Governing law and changes

These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. We may update these terms for future service periods by posting a revised version and providing notice when a change materially affects an active client.
